    IN EXECUTION of a Deed of Trust dated the 4th day of May, 2022, in principal amount of $79,524.39 recorded in the Clerk's Office of the Circuit Court for Dickenson County, Virginia, as Instrument No. 220000562, in Deed Book 594, Page 101, and default having occurred thereunder, the undersigned Substitute Trustee, appointed by document recorded in Deed Book 627, Page 606, having been requested to do so by the Beneficiary, will offer for sale at public auction at the Front Door of the Dickenson County Courthouse, Main Street, in the Town of Clintwood, Virginia, [NOTICE: THIS SALE WILL NOT TAKE PLACE ON THE PREMISES OF THE PROPERTY BEING SOLD]
on the 7“ day of May, 2026, at 1:30 PM
the following described property, together with all improvements thereon, situate, lying and being on Caney Ridge, in the Kennady Magisterial District of Dickenson County, Virginia, more particularly described as follows, to-wit:
    BEGINNING at an iron pipe near the top of the slope on the north side of the old Caney Ridge road, an original corner to the Blanche Freeman 38 acre tract thence, with a line of said tract, N 14 17’ W 227.8 feet to a large chestnut stump on top of a spur; thence N 5 00' E 190.4 feet to a fence post on the west side of the Alley Cemetery; thence N 28 50' W 29.0 feet to a stake; thence N 39 55' E 22.5 feet to a double maple on the north side of the cemetery; thence, continuing N 39 55' E 45.0 feet to a stake on the northeast side of the cemetery; thence 85 30' E 284.5 feet to a stake near some draw bars; thence S 43 00' E 666.7 feet to a stake on the south side of Caney Ridge highway, a corner to the Troy Freeman, Jr. 43 00' E 666.7 feet to a stake on the south side of Caney Ridge highway, a corner to the Troy Freeman, Jr. and Worley Smith tract; thence, with lines of the same, S 74 15' W 428.5 feet to a stake on the south side of said road; thence N 75 40' W 285.6 feet to the BEGINNING, and containing seven acres, more or less.
    BEING that same property heretofore conveyed to Jimmy Ray Baker and Reba Jean Baker, his wife, by Deed dated May 4, 2022, from Cody Funk, Troy O. Freeman, Jr. and Linda Freeman and recorded in Deed Book 594, Page 98, in the Clerk's Office of the Circuit Court for Dickenson County, Virginia.
    There is also granted to the Grantee the use of any and all easements, right of ways, roadways, water rights, pipeline rights, sewer systems including any field lines attached thereto, in existence and which lawfully may be used by Grantors, whether by express grant, prescriptive use or otherwise and which are appurtenant to and part of the use and enjoyment of this particular tract of land.
     There is also conveyed by this instrument all buildings, improvements, fixtures, easements and appliances now or hereafter attached to or used in connection with the property herein attached.
   LIENHOLDER RESERVES THE RIGHT TO BID OR TO REJECT ANY BIDS. TO VIEW THIS PROPERTY, CONTACT RENEE RAY AT MINERS EXCHANGE BANK.
    TERMS OF SALE: Cash. A deposit of 10% of the sale price in cash or certified check may be required at the time and place of sale with the balance of the sale price to be paid at settlement, to be held within THIRTY (30) days from the date of the sale; should purchaser fail to complete purchase within 30 days, the deposit is forfeited and the sale subject to termination or a charge of daily per diem interest thereon until closing date at option of Lienholder. The property and any improvements thereon shall be sold in "AS IS, WHERE IS" condition without any warranties. Title shall be transferred by Special Warranty Deed, and Buyer shall be responsible for all costs of conveyance including but not limited to deed preparation and all fees to transfer title. Sale is subject to such additional terms as Trustee may announce at the sale.
    This is an attempt to collect a debt and any information obtained will be used for that purpose.
