   In execution of a certain Deed of Trust dated July 6, 2022, in the original principal amount of $325,000.00 recorded in the Clerk’s Office, Circuit Court for Dickenson County, Virginia, in Book 596 at Page 332 as Instrument No. 220000833, re-recorded in Book 596 at Page 618, re-recorded as Instrument No. 220000896. The undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Dickenson County, 293 Main St., Clintwood, Virginia, or any such temporary alternative Circuit Court location designated by the Judges of the Circuit Court, on October 28, 2025, at 1:30 PM, the property described in said Deed of Trust, located at the above address, and more particularly described as follows:      
    BEGINNING AT A STAKE ON THE EAST SIDE OF A FENCE AND ON THE EAST SIDE OF THE CANEY RIDGE ROAD; THENCE S 61 10 E 246.0 FEET TO A FOUR-INCH SASSAFRAS IN A FLAT FIELD; THENCE N 63 20 E 294.2 FEET TO A TWENTY-INCH SUGAR MAPLE ON A HILLSIDE FACING EAST; THENCE N 65 40 E 381.2 FEET TO A STAKE IN THE SULPHUR SPRING HOLLOW AND IN A LINE OF THE OLD J.G. KENNEDY TRACT; THENCE, WITH SAID LINE, DOWN THE HOLLOW, S 42 55 E 192.0 FEET TO A TWELVE-INCH BEECH AND A SIX-INCH BUCKEYE IN THE HOLLOW (ASH AND SOURWOOD WITNESSES); THENCE S 40 55 E 225.2 FEET TO A FIVE-INCH STOOPING DOGWOOD IN THE EAST SIDE OF THE HOLLOW; THENCE S 10 52 E 453. 7 FEET TO A TWELVE-INCH BEECH, UPROOTED AND DEAD, AT THE EAST SIDE OF A SMALL RIDGE BETWEEN TWO BRANCHES (TWO HEMLOCK WITNESSES, ONE DEAD); THENCE CONTINUING, S 10 52 E 26.0 FEET TO A STAKE AT THE EAST SIDE OF THE ABOVE DESCRIBED RIDGE (HEMLOCK AND MAPLE WITNESSES) AND IN A LINE OF THE VIRGINIA IRON COAL AND COKE COMPANY`S 139.15 ACRE, C.C. HUTCHINSON TRACT; THENCE, WITH A PART OF SAID LINE S 55 28 W 178.5 FEET TO A STAKE IN THE NORTHEAST SIDE OF A SAG (BEECH AND HICKORY WITNESSES) THENCE, CONTINUING N 67.00 W APPROXIMATELY 1175 FEET TO A STAKE ON THE EAST SIDE OF CANEY RIDGE ROAD; THENCE, ALONG THE EAST SIDE OF CANEY RIDGE ROAD N 600 E 276 FEET TO THE BEGINNING, CONTAINING 10.66 ACRES, MORE OR LESS.  
  TERMS OF SALE: ALL CASH. A bidder’s deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject Deed of Trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser’s deposit may be forfeited to Trustee. Time is of the essence.  If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid. The Purchaser may, if provided by the terms of the Trustee’s Memorandum of Foreclosure Sale, be entitled to a $50 cancellation fee from the Substitute Trustee, but shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney.
